Re: Advice for caught speeding (over 100mph)?
the Police attempt to resolve most offences by way of a Fixed Penalty Notice, at excessive speeds, a Court appearance is inevitable. For speeds in excess of 100 mph (or more than 30 miles above the relevant limit) the punishment starts at disqualification as opposed to penalty points. However, the decision is at the discretion of the Court and in certain circumstances, a disqualification can be avoided but unlikely
Generally speaking, the higher the speed, the greater the risk of an instant ban and as a general rule of thumb, when the speeding offence is in excess of 45% of the speed limit, there is a risk of an instant driving ban:
Disqualification if caught speeding in these zones at these speeds
30 mph In excess of 51 mph
40 mph In excess of 66 mph
50 mph In excess of 75 mph
60 mph In excess of 85 mph
70 mph In excess of 100 mph

Re: Advice for caught speeding (over 100mph)?
Small update...
They sent a letter asking how he'd like to plea and for any explanation. My mate sent a letter back that accepted guilt and was apologetic.. that is all....
We are now speculating that a court appearance may not be required after all, or is this just part of the normal process?

all part of the paper trail. they have him admitting guilt now.
all depends if the judge is a fan of bikers and how dangerous he feels your mate was.

I looked this up btw... They could, and likely would, just issue a bench warrant for his arrest and detainment.Ruffian wrote:If he didn't attend court then would probaby be just kicking the bear,
Would get worst case punishment chucked at them
So probably best he takes that day off work and go stand in court and stare at his shoes for 30 mins.

If he is going to giggle,
Tell him to squeeze a testicle through his pocket.
Brought a tear to my eye quite quickly when I needed to plea.

Right... we have a conclusion.
No solicitor needed, he represented himself.
Max fine was issued but 1/3 discounted due to guilty plead, plus court fees & victims surcharge (not sure who the victim was, the road maybe, or was it the bike...?) - £800 total.
Disqualification was being considered but due to the impact this would have on work/family 6 points were awarded instead.
So all in all it wasn't a bad outcome, not great but could have been worse. A short disqualification would have been nice (1-2 weeks) but a long disqualification would not have been.
So as had already been stated in this thread, it was the best course of action to make a case for not getting a disqualification.
Now he has to let all his insurance companies know what he's done - ouch!
Interestingly he did do some online quotes to see what the difference would be between just having the 6 points against being banned, average difference was £120 extra per policy... so it does pay to avoid disqualification if you can.

P.'s you don't have to inform insurance companies until renewal.
If it's mid term you don't have to tell them.
