Hi Guys,

There was some conversation yesterday regarding hitting a vehicle that stops in front of you.

Dislaimer - I'm not saying that this does/doesn't apply to yesterday, its more a general principle!

Whilst generally, its the person behinds fault by not giving enough space White Dalton say "...While the general rule is that if you run into the back of someone else it will be your fault, it’s a popular misconception that it’s always the case..."

This is worth bearing in mind if you are ever in this sort of scenario.

In any civil claim the defendant's riding is measured against that of a reasonably competent rider and if on the balance of probability the defendant fell below that standard compensation is awarded to the claimant but reduced by a suitable measure to reflect the claimants conduct if it also fell below the standard of a competent rider and contributed to the probability of the accident occuring, hence the claimant was contributory negligent.

Apply this reasoning to the facts of any accident to guess the courts decision generally.
