2 Parking Tickets in 30 mins. £200 :l

If any of you know the parking outside of Central station in Exeter.. don't park their. Or, down in the car park next to CCI (the college.)

I park my bike in the college car park everyday. It's free and there's a designated bike parking spot at the back of the car park. I was getting picked up to go to a party wensday night down by college. So, I thought i'd leave my bike covered and locked up in the FREE 24 hour bike parking area next to the college. Maybe not such a good idea. :lol:

anyway.. i came back the next day to find the big red sticker on my bike with a £40 quid fine in it; £100 if it isn't paid within 7 days. this ticket was issued at 9.18am on thursday morning (a got ther at half past). :evil:

recently my bike hasnt been to great with starting. And because it'd been left outside that night, i spent 30 mins trying to start it in the car park and had no luck :? i then left the bike in a diffrent part of the car park.. parked outside of the painted spaces and actual car park then walked up to the phone box to get the recovery out to take me home. when i got back, their she was at a little past 10am writing me out another £40 ticket. I 'politly explained' to her that i was unable to move the bike and the van was on it's way.. and i was let off. if i was gone within 20 minutes! :lol:

then, as she was driving off..the bike started and ticked over perfectly. :roll: :roll: luckily she didnt notice.

i'm gonna give it a shot at riggling my way out of it like usual. i'm gonna write saying that my bike was already broken down the night before and i had to leave it there until it could be picked up the next morning... and that i should be let off the fine on the same basis that i was let off it for being broken down in the morning. hopefully it'l work, i've written to the same company before and got away with it when i parked it on the pavement for 20 mins outside Central Station, complaining that the bike parking outside the station was not marked out clearly! :lol:

Anyone else have any better ideas? / stories etc?? Cheeeeers! :) :)

I would say take a look at Kim's thread mate, but i see you already have! I'm sure you'll be able to get your money back. Take photos of where it says free 24 hour bike parking and you'll be fine.

It is illegal to park a motorcycle on a Council owned pavement Anywhere in Exeter, unless the space is specifically designated. Park on pavements at your peril :roll:

It is also illegal to park in a "residents parking" section of a public road, a vehicle which cannot be moved - as I found to my cost oce when changing tyres on my motorbike.

Equally though, there are ways to get around things ..... I used to live in a road with a coucil residents parking system. Outside my house was actually the 2hr limited waiting area, and we had many battles with the wardens over parking there, until I discovered that as long as the bike was covered with a well secured cover, they were not allowed to lift/move/interfere with it to get the registration number :wink:

my bike was covered and clipped underneath the bike. when i got there in the morning it had ben un done and had blown half off!...

But the key difference is that in the college car park you are on private (as opposed to public) property, and I don't know what difference that would make - I am guessing you would have to ask the college what their policies are governing the management of car parking areas.

yeh i suppose. just pissed me off abit that she messed around with my bike cover and then didnt leave it like it was. forgot to mention about this part.

check the CCTV for the carpark, if she has removed ur bike cover then game on :D

I've just had a thought ....... exactly which car park were you in - the proper college car park or the adjacent private (pay-and-display) one ?

If it's the latter, there is no "free" area - you are either parked within a designated car space, or are parked illegaly and will get ticketed/clamped. In that car park, even if you have bought a ticket from the meter but have not parked within one of the clearly marked, designated spaces you will still be ticketed or clamped :!:

Who did the woman who gave you the ticket work for? Was she a traffic warden or an agent for a private parking management company? I'm guessing she didn't work for Sapphire Security - the company which manages the car park outside Central Station - by the fact that you say there was a big red sticker, as Sapphire Security placed a yellow 'Penalty Charge Notice' sticker on my car - the same sort as that issued by Traffic Wardens - which is illegal, as they are only a private company and not employed by the Local Authority. I am currently battling with Sapphire Security, through the Police and also Trading Standards over this point - it is a breach of s.40 of the Administration of Justice Act 1970. You might like to take a look at ticketfighters.co.uk.

If she was an agent for a private company and the ticket was called anything like 'penalty charge notice' or included wording to the effect that it was a criminal offence for anyone other than the driver of the vehicle to remove the notice, etc, then you may well be able to use the same argument as me - they have committed a criminal offence by breaching s.40 of the above act...
