Your forks do not spend all their time in compression, as they follow the road they are also in extension. Your forks will leak, I spent several years teaching motorcycle mechanics at college both to full timers and those working in the trade on day release, before leaving and buying my dyno, ( mainly because I was tired of dealing with students who would dispute whatever they were told or shown, usually followed by "my mate said" or "my dad says" "fastbikes said" and would given the chance argue black was white)
Regardless of what you may believe your bikes handling will be compromised and your forks will leak what little oil remains in them. The chances are most of the oil has now left the fork leg ( there's less than a pint to start with) and what little remains will not be damping the spring action anywhere near effectively. Just bite the bullet and fix them rather than stubbornly continuing to argue in the face of overwhelming evidence to the contrary. I really hope in the meantime that nobody is daft enough to get on the back of you, and if you continue to thrash around (as fast as 33bhp will take you, assuming you've not removed the restrictor kit already) pretending to be Rossi, that you are lucky enough to only injure yourself rather than anyone else when it all goes pear shaped. If you are going to ride at the limits of either your ability or the bikes, then the bike needs to be in good condition.

Why not put the bike on stands again and lean it the other way for a night so some leaks out the other fork leg thus solving the problem, Im sure theres and old cooker etc that you could lean it on

If you have a 'puddle' of oil and each fork leg contains less than 500ml of oil total, then I would say you've lost enough oil to be concerned. Even if you only replace the oil and not the seals.
