Sorry to read about the crash. Your right about car drivers. I learnt to drive in London area **** years ago. My dad said to treat everyone on the road as a complete idiot and you wont go far wrong. After riding again for a couple of years i always do a double take before changing direction in the car. They should make it compulsory. Except for old gits with arthritis, who should just have a flag attached to the car. Get well soon.

I had a similar thing happen about 3 yrs back on a 125, that wasn't as clear cut as I was filtering, and he pulled out (filtering is a grey area legally!)...but I still won that case, took 2 yrs though!!!
This time though, it's blatently obvious I did everything correctly, and he didn't look, just slapped the indicator on, and straight away thought that gave him right of way to just pull out there and then...
It's taught to both bikers and other road users like cars, that you should always check before a manavour to make sure it's safe to do so...
that's set in stone, he didnt do that, so I'm gonna try to have him for driving "without due care and attention"
Anyway now I've been up for a while, feeling a bit better, walking up and down stairs still a bit of an issue, but am a bit more mobile than I was yesterday

Not true! I was never taught that, not for making a right turn. Of course he should have signalled much sooner so he is guilty of bad driving and I hope there were witnesses. That said you still broke a cardinal rule of safe motorcycling - never overtake near junctions. When doing Car lessons, I've been taught to look also
Ok overtaking near junctions is not the brightest move in the world, but it was a dead end side street, risk was very low.
Fact of the matter is, I was in plain open view, he didn't look, didn't give any time to signal, he just stuck his indicator on and thought that gave him instant safe passage to turn, he didn't take into the account the safety of any other road users, in this instance, me!
Anyway my quick actions avioded him with a bike dent in his car, but also ended up with me flying in the air, so he got off lucky really under the circumstances, but I'm going to try my hardest to get his insurance to pay out for injury's to me and the bike soon as the police get back to me.

Call me naive, but did the inconsiderate git stop to see if you were ok after you came off or did he just drive away. Coz I think that you could probably have him done for that as well if he did. I remember when my Dad came off his Harley due to a car cutting him up by just ignoring him the bloke failed to stop at the scene of the accident and they got him on that. I hope they throw the book at him

Na he did stop, but whilst I was screaming in agony all I could hear him saying was to a passer by that it wasn't it fault...

At the time I felt it was my fault, but now I've had a chance to sit down and think over exactly what happened, I know it's him who is in the wrong, and the police got back to me yesterday, seems their was a star witness who saw it all, the car behind him!
The Bloke in the car behind was really helpful he talked to me the whole time till the ambulance turned up and sorted me out, I'll have to send him a box of chocs or something in the post he was great I'm so glad he was there to help
I was quite lucky, as the poilce officer on the scene, is a biker himself in his spare time, and was keen to get all the info for me, he thought I wouldn't have a case, as it happened just after zigzag lines on a pedistrian crossing, but if you look in the highway code, you can overtake on them so long as the lights are not red and/or someone is crossing at the time (Common sense really!)
Anyway I'll be contacting the insurance, I'm only Third party, but I always take out legal/accident cover so I'll use that to do the work for me, least this time, it was more clear cut, and there was an eye witness, so shouldn't take too long, hopefully only a few mnths, to get it all sorted out

I didn't mean to imply that I thought it was in any way your fault.
I agree that the driver should check his blindspot before turning, which he obviously didn't do.
Its just that its better to avoid any accident even if it is the other person's fault.
